Synthetic Stucco Class Action Lawsuit
5/29/1998

On May 15, 1998 the Superior Court, County of New Hanover North Carolina issued a notice of a pending Proposed Partial Settlement of a Class Action Lawsuit on behalf of all persons or entities who owned or own residential property in the United States on which Senergy, Inc. ("Senergy"), or Thoro Systems Products, ,Inc. ("Thoro"), Exterior Insulation and Finish Systems ("EIFS") was installed. This is a result of the "Ruff v. Parex" lawsuit which was certified as a class action within the State of North Carolina on September 18, 1996. It is possible that this action may be expanded to include other manufacturers, or that new class action lawsuits may occur outside of North Carolina.

A Fairness Hearing will be held on September 11, 1998.

The defendants claim that EIFS as part of the exterior walls of residential dwellings are defective because they are a barrier system entrapping water and cause damage to the homes. EIFS are multi-layered exterior wall systems consisting of a finish coat, a base coat, a plastic mesh and insulation board, all of which are mechanically or adhesively secured to plywood or other sheathing substrate. EIFS are available in various external textures designed to look like traditional stucco.
