Texas Standard Property Inspection Form

The Texas Standard Property Inspection Form is no longer mandatory for relocation inspections. The Texas Real Estate Commission (TREC) on March 23, 1998 proposed new regulations that will exempt relocation management companies or a seller1s employer from using the state mandated Texas Property Inspection Report Form which became effective on January 1, 1998. The ERC Home Inspection Report Form could not be used under the regulations in force after January 1, 1998. TREC passed a resolution at its meeting clarifying the intent of the commission whereby relocation management companies or seller1s employers were exempt from using the mandated form, thus allowing relocation companies to immediately use any form they desire. However, for disclosure purposes a notice substantially similar in content to the following must be on the first page of the report:
"This report was prepared for a relocation management company or the seller1s employer in accordance with the company1s requirements. The report is not intended as a substitute for a comprehensive inspection of the property by an inspector of the buyer1s choice. Standard inspection forms required by the Texas Real Estate Commission may contain additional information a buyer should consider in making a decision to purchase."
Final action on the regulation will be at TREC's next meeting on June 15,1998 and all parties expect the proposals to be adopted at that time. Additional details and updates can be obtained from the TREC web site: www.trec.state.tx.us
